JUSTICE SANDEEP KUMAR ORAL ORDER 07-03-2022 At the very outset, learned counsel for the petitioners submits that the present application has become infructuous as against the petitioner No. 1 and petitioner No. 5 who have been arrested and seeks permission to withdraw the same. It is, thus, dismissed as withdrawn as having become infructuous as against the petitioner No. 1 and petitioner No. 5. Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

Patna High Court CR. MISC. No.38270 of 2021(2) dt.07-03-2022 2/2 The petitioners apprehend their arrest in connection with Chakai P.S. Case No. 12/2021 registered for the offences punishable under Sections 304B/34 of the Indian Penal Code. There are general and omnibus allegations against the petitioner No. 2 who is brother-in-law of the deceased whereas petitioners No. 3 and petitioner No. 4 are the father-in-law and mother-in-law of the deceased and they are 75 years and 69 years of age.

Considering the facts and circumstances and taking into consideration the age of petitioners No. 3 and 4, the present anticipatory bail application is allowed.

Accordingly, let the petitioners No. 2, 3 and 4 above named be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 5th , Jamui, in connection with Chakai P.S. Case No. 12/2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
