JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-07-2024 The present writ petition has been filed seeking the following relief:- "1. That by this writ application, the petitioner craves indulgence of this Hon'ble Court for issuance of appropriate writ/ direction/ order to the respondents to maintain the height of Drain below the plinth level of houses which is being constructed in Ward No. 24, Bengali Tola, Farbesganj and direction to lower down the height of the drain which has been constructed about 11⁄2 feet height from the Road level height and the plinth level of the houses creating insurmountable misery and problems to the petitioner and other residents of the locality and there is immense danger of water

2. At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the respondent no.4, i.e. the Executive Officer, Nagar Parishad, Farbesganj, District-Araria for redressal of his aforesaid grievances. Liberty, so sought, is granted.

3. It is needless to state that in case appropriate petition is filed by the petitioner before the respondent no.4, within a period of four weeks from today, the respondent no.4 shall consider the same and pass appropriate orders, in accordance with law, forthwith.

4. The writ petition stands disposed off on the aforesaid terms.
