JUSTICE SANJAY PRIYA ORAL ORDER 02-07-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Bhagwanpur P.S. Case No. 44 of 2018 instituted for the offence under Sections 341, 323, 307, and 447/34 of the Indian Penal Code. In the written report there is specific allegation against petitioner of assaulting son of the informant on his head with Lohbanda on account of which, son of the informant has sustained serious injury.

Case dairy has been received.

The injury report of son of the informant is available in the case diary wherein the Doctor has found one injury on scalp to Bone on left side of parietal region measuring 4" x 1/4" and

Patna High Court Cr.Misc. No.31122 of 2018 (3) dt.02-07-2018 2/2 after X-ray fracture of skull bone was found which was found to be grievous in nature.

Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail which shall be considered by the court below in accordance with law without being prejudiced by this order.
