The petitioner seeks regular bail in connection with Dumra Police Station Case No. 165 of 2019, registered for the offences punishable under Section 379 of the Indian Penal Code.

The allegation, as per the First Information Report, is that the informant parked his motorcycle near the Civil Court and when he returned back, he did not find his motorcycle and the same was stolen.

Learned Counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has been implicated in this case on the basis of the

Patna High Court CR. MISC. No.28531 of 2020(2) dt.12-11-2020 2/2 confessional statement of the co-accused Saddam Ansari @ Kobra. He further submits that no incriminating articles and/or the stolen motorcycle has been recovered from the possession of the petitioner and the petitioner is in custody since 17.08.2019. After having heard learned Counsel for the parties and taking into consideration the materials on record and the fact that the petitioner is in custody since 17.08.2019, I am inclined to grant bail to the petitioner.

This application is, accordingly, allowed.

Let the petitioner, above named, be released on bail, upon furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sitamarhi, in connection with Dumra Police Station Case No. 165 of 2019. It is further made clear that at the time of furnishing bail bonds, all the parties shall follow the guidelines regarding social distancing.
