====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 03-02-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 403, 420 and 34 of the Indian Penal Code.

The informant alleges that the petitioner, being ward member along with Ranjan Yadav being member Secretary of Ward No. 2 in Gram Panchayat Sondhiha Dakshini, misappropriated and embezzled Rs. 10,49,500/- allotted for execution of Mukhya Mantri Gramin Pay Jal Nishchay Yojana. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is in custody since 09.07.2021 and is a women.

No.30018 of 2022(4) dt.03-02-2023 2/2 Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that the work was nearing completion when the FIR came to be instituted, it is also submitted that had an opportunity been given to the petitioner seeking an explanation, perhaps the present FIR would not have been instituted. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Banka (Barahat) P.S. Case No. 113 of 2021.
