The petitioners apprehend their arrest in connection with Naubatpur P.S. Case no. 349 of 2016, registered under Sections 147, 148, 149 and 307 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that due to land dispute six accused named in the F.I.R., including the petitioners, reached at the house of the informant Lalan Yadav and started firing in which Ashok Kumar, son of the informant, sustained injury in the firing made by co-accused Atul Singh, son of Chhote Lal Singh.

No.31348 of 2018(2) dt.12-06-2018 2/2 Learned counsel for the petitioners submits that, admittedly, there is land dispute in between the parties and petitioners have falsely been implicated in this case with ulterior motive. Further submission is that it would appear from the F.I.R. that firing of co-accused Atul Singh hit the son of the informant. Further submission is that while petitioners are named in the F.I.R. but no specific overt act has been attributed against the petitioners.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M-II, Danapur in connection with Naubatpur P.S. Case No. 349 of 2016, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
