====================================================== CORAM: HONOURABLE MR. JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 11-08-2025 Heard learned counsel for the petitioner and learned APP for the State as also learned counsel for the Informant. Perused the case diary.

2. The petitioner seeks bail in connection with Bettiah (Muffasil) P.S. Case No. 664 of 2024 instituted for the offences under Sections 103(1) and 3(5) of the Bhartiya Nyaya Sanhita, 2023.

3. As per prosecution case, the petitioner is alleged to have killed the Informant's son by slitting his throat by means of knife.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence as alleged

Patna High Court CR. MISC. No.29027 of 2025(3) dt.11-08-2025 2/3 against him and has falsely been implicated in the present case due to ulterior motive and on the basis of suspicion. There is no eye-witness to the alleged occurrence. Even the Informant is the not the eye-witness rather the informant has lodged the F.I.R. after recovery of the dead-body. The name of the petitioner has surfaced in this case only on the basis of suspicion. The police arrested the petitioner and recorded his confessional statement which has no evidentiary value in the eye of law. Save and except his confessional statement, there is nothing against the petitioner in the entire record of the case. The petitioner has no concern with the alleged occurrence. The petitioner has two criminal antecedents and is languishing in judicial custody since 15.12.2024 without any rhymes or reason.

5. On the other hand, learned A.P.P. for the State as also Informant have vehemently opposed the prayer for grant of bail to the petitioner. It is further submitted that there is direct allegation against the petitioner of slitting the throat of the deceased by knife. Learned counsel for the Informant submits that the trial is going on and two witnesses have already been examined. The Investigating Officer, after completion of investigation, has submitted charge-sheet against the petitioner for offence under Sections 103(1) of the Bhartiya Nyaya

6. Having heard learned counsel for the parties and considering the nature and gravity of the offence as alleged against the petitioner as also taking into account that the trial is going on, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, the prayer for bail of the petitioner, above named, is rejected at this stage with a direction to the court below to expedite the trial and conclude the same expeditiously.
