ANJANA MISHRA ORAL ORDER 19-11-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Ahiyapur P.S. Case No. 366 of 2016 for the offences registered under Sections 272 and 273 of the Indian Penal Code and Section 47, 50 and 51 of the Bihar Excise Act (Amended) 2016. Learned counsel for the petitioner submits that there was no recovery from the conscious possession of the petitioner. He has been implicated in connection with the present case on account of dirty village politics.

Considering the nature of allegation made against the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four

Case No. 366 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
