It is being pointed out that as on the date of the passing of the order, dated 27.09.2016, Basant Sah (petitioner No.1) was already taken into custody, which fact had not been brought to the notice of this Court.

Let the order dated 27.09.2016 passed in Criminal Misc. No. 41010 of 2016 be treated to have been passed in respect of petitioners other than petitioner No.1 (Basant Sah). So far application of anticipatory bail of the petitioner No.1 in Cr. Misc. No. 41010 of 2016 be treated to have been dismissed as infructuous.

The time granted to rest of the petitioners to appear before the Court below is, hereby, extended by one week more from today.

This application stands allowed.
