====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 24-05-2018 Heard learned counsel for the petitioner and the State. Petitioner is apprehending his arrest in Bahadurpur P.S. Case No.520 of 2017 for the offences registered under Sections 341, 342, 323, 324, 504 and 307 of the Indian Penal Code. It is alleged that petitioner came at the shop of the informant and demanded Gutakha and thereafter he took away his mobile. When informant went to petitioner's tea shop to take back his mobile. Thereafter when informant started his motorcycle petitioner attacked upon him with knife and gave several blows. Thereafter petitioner took away Rs.4600/- from the pocket of informant and fled away.
It has been contended on behalf of the petitioner that he is innocent and has committed no offence. He has falsely been implicated in this case due to local politics. He has got no criminal antecedent. The two injuries caused are simple in nature and no offence under Section 307 of Indian Penal Code is made out.
Considering the facts and circumstances of the present
Patna High Court Cr.Misc. No.31158 of 2018(2) dt.24-05-2018 2/2 case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/ (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Darbhanga in Bahadurpur P. S. Case No.520 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (S. Kumar, J) sudip/manoj U T
