The petitioner seeks bail in connection with Sessions Trial No. 639A of 2013 (CIS No. - 211552/2019) arising out of Barauni (Chakia) P.S. Case No. 39 of 2013 dated 03.02.2013 instituted for the offences under Sections 399, 402 and 120B of the Indian Penal Code and under Sections 25(1-b)a, 26, 35 of the Arms Act.

The petitioner was earlier granted bail but the privilege of bail was cancelled because of the petitioner having jumped bail bonds. The bail of the petitioner was cancelled on 05.09.2016. The petitioner is in custody since 12.12.2019.

Regard being had to the period of custody spent by the petitioner, he is directed to be released on

Patna High Court CR. MISC. No.25289 of 2020(3) dt.02-11-2020 2/2 bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-III, Begusarai in connection with Sessions Trial No. 639A of 2013 (CIS No. - 211552/2019) arising out of Barauni (Chakia) P.S. Case No. 39 of 2013.

However, the petitioner shall participate in the trial and his absence from the trial proceedings on two consecutive occasions without any plausible reason or seeking permission from the trial court, the bail granted to the petitioner would be liable to be cancelled. In that event the trial court shall proceed for cancellation of bail of the petitioners.
