JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This is an application for anticipatory bail for the offences under Section 395 of the Indian Penal Code. Three cases except the present case, namely Madanpur P.S. Case No. 230/12, Salaiya P.S. Case No. 61/14 and Salaiya P.S. Case No. 28/10 were lodged against the petitioner and he has been made accused in those cases. Petitioner has been enlarged on bail in Madanpur P.S. Case No. 230/12. Now warrant has been issued against the petitioner in the present case. The allegations against the petitioner are similar in nature. Heard learned APP appearing for the State, who opposed the prayer for anticipatory bail.

Patna High Court Cr.Misc. No.49278 of 2016 (2) dt.19-12-2016 Having heard both sides and in view of the facts and circumstances of the case, the prayer of the petitioner is rejected. However, if the petitioner surrenders before the Court below and seek regular bail, the same shall be considered and disposed of on its own merit without being prejudiced by the present order if possible, on the same day taking into consideration that on similar allegation, he has earlier been enlarged on bail.
