The petitioner apprehends his arrest in Udwant Nagar P.S. case No. 184 of 2017 for the offences punishable under Section 409, 420 of the Indian Penal Code and under Section 7 of the E.C. Act.
The gist of the allegation is that the petitioner was removing subsidized food grains from the house of Bijendra Kumar Singh to the house of Kishun Mahto.
The learned counsel for the petitioner submits that Bijendra Kumar Singh has already been granted anticipatory bail vide order passed in Cr. Misc. No. 42509 of 2017. The petitioner is not a PDS dealer. Bijendra Kumar Singh is PDS dealer and no offence under Section 409, 420 of the IPC and under Section 7 of
Patna High Court Cr.Misc. No.49030 of 2017 (2) dt.17-10-2017 2/2 the E.C. Act is made out against the petitioner Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub divisional Judicial Magistrate, Bhojpur, Ara in connection with Udwant Nagar P.S. case No. 184 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
