2. The petitioner apprehends his arrest in Buniyadganj P.S. Case No. 175 of 2020, registered for the offences punishable under Sections 307, 147, 148, 149, 323 and 379 of the Indian Penal Code and Section 27 of the Arms Act
3. Prosecution case in brief is that on the alleged date and time of occurrence, the FIR named accused persons along with 10-12 unknown persons assaulted the informant and his son and looted cash from the shop of the informant and other shopkeepers.
4. It is submitted on behalf of the petitioner that petitioner is not named in the FIR. His name transpired during course of investigation. As per FIR, named accused persons have
Patna High Court CR. MISC. No.32081 of 2024(2) dt.12-07-2024 2/2 committed the offence. There is no specific allegation against the petitioner. No incriminating article has been recovered from the possession of the petitioner. Petitioner has one criminal antecedent of different nature in which he is on bail.
5. Counsel for the State however, vehemently opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within a period of six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-VII, Gaya in connection with in connection with Buniyadganj P.S. Case No. 175 of 2020 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
