The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 325, 354, 379, 447, 448, 504, 506, 34 of the Indian Penal Code.
It is a case of assaulting the informant and outraging the modesty of the daughter of the informant. It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case as the petitioner and the informant are next door neighbour. Moreover, the injuries sustained by the informant are not on vital part and the case of outraging the
Patna High Court CR. MISC. No.38601 of 2021(2) dt.21-03-2022 2/2 modesty of the daughter of the informant is false and fabricated because the time and date has not been mentioned in the F.I.R. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Learned APP for the State has opposed the prayer of bail.
Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna City in connection with Malsalami P.S. Case No. 121 of 2021 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
