Heard the counsel for the State, the private respondent as well as Zila Parishad.

The application seeks a direction to set aside the order by which the respondents accepted the resignation of the petitioner from the elected post of Member of Zila Parishad. The counsel for the respondents have rightly pointed out that the application has now become infructuous, as the tenure of the post expired and fresh elections have already announced.
