Petitioner seeks pre-arrest bail in Sadar (Hajipur) P.S.Case No.415 of 2018 registered under Sections 30(a), 37 (a) (d) of the Bihar Prohibition and Excise Act and Section 11 of the Bihar Bengal Gambling Act.
Allegation against the petitioner is of recovery of empty bottle of wine and one bottle of liquor from the poultry farm and the petitioner is named in the F.I.R.. Submission on behalf of the learned counsel for the petitioner is that poultry farm is not of the petitioner and, as such, there is no allegation of recovery from the house of the petitioner and he has got no criminal antecedent.

Having heard both sides and in view of the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the learned court below within six weeks from today be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of Addl.Sessions Judge-Iind- cumSpecial Judge, Excise, Hajipur, Vaishali, in Hajipur Sadar P.S.Case No.415 of 2018 subject to the conditions as laid down under Section 438(2) of Cr.P.C. and further condition that the bailors must be of local having sufficient movable and immovable properties within the jurisdiction of the court concerned.
