The petitioner is apprehending his arrest in connection with Arrah Nagar P.S. Case No. 481 of 2017 registered for offences punishable under Sections 406, 409, 420, 467, 468, 471 and 120(B)/34 of the Indian Penal Code.
Allegation against the petitioner, who is Assistant Engineer, is of not deducting royalty and cess from the bill of Contractor, causing wrongful gain to co-accused. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and the allegations made in the FIR is general and omnibus. Patna High Court Cr.Misc. No.31530 of 2018 (2) dt.23-05-2018 2/2 been granted bail by coordinate bench of this Court, vide order dated 12.12.2017 passed in Criminal Misc. No.58238/2017 and vide order dated 17.02.2018 passed in Criminal Misc. No.7814/2018. It is further submitted that the petitioner has no criminal antecedent.
Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender in the court below within four weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount in connection with Arrah Nagar P.S. Case No. 481 of 2017 to the satisfaction of learned Chief Judicial Magistrate, Arrah, subject to the condition laid down under Section 438 (2) of the Criminal Procedure Code.
