JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-07-2019 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. The petitioner apprehends her arrest in Aurangabad (Mufassil) P.S. Case No. 216/2018, registered for the offences punishable under Section(s) 341, 342, 323, 308, 379, 385, 427, 504, 506 and 34 of the Indian Penal Code.

Prosecution case in brief is that on 26.12.2018 at night while informant was going from his village Padrawan to Aurangabad by his Scorpio vehicle, near Cement factory his Scorpio was overtaken by another Scorpio and forcibly stopped the vehicle of informant. Thereafter, five persons variously armed came out of the said vehicle and smashed the glass of the informant's vehicle with the butt of the rifle and started assaulting the informant and also snatched cash, mobile, ornament and other articles. It is submitted on behalf of the petitioner that there is no specific allegation against this petitioner. Petitioner has been named in the F.I.R. simply because she is owner of the vehicle and no overt act has been alleged against her. Petitioner is a lady and has got no criminal antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of her arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Mufassil) P.S. Case No. 216/2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
