APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PARTHA SARTHY ORAL ORDER 16-01-2023 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners have preferred this application for grant of regular bail in a case registered under sections 304B, 328 and 34 of the Indian Penal Code.

As per the prosecution case, the informant states that he received information about his daughter having consumed poison in her sasural. She died on way to the hospital. The informant further states that the accused persons including the two petitioners herein physically and mentally tortured the informant's daughter for reason of non-fulfillment of the demand of dowry.

It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in the case on

From paragraph no. 18 of the case diary it is evident that the husband is in custody. The informant is not an eye witness to the occurrence. The allegations besides being general and omnibus in nature, are false and concocted. The petitioners are in custody since 18.8.2021.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the material that has transpired in course of investigation, the husband of the deceased being in custody and the petitioners who are the mother-in-law and father-in-law of the deceased being in custody for 1 year 4 months since 18.8.2021, the Court directs the above named two petitioners to be enlarged on bail in connection with Udwantnagar P.S. Case no. 358 of 2021 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge XIV, Bhojpur, Ara.
