This application for grant of anticipatory bail arises out of Lalganj P.S. Case No. 213 of 2016, disclosing offences under Sections 147,341,323,337,338,326,379,504 of the Indian Penal Code.
The informant and the petitioner are said to be the agnats, between whom some land dispute is said to pending. It is alleged that the petitioner and his family members, who have been made accused, started hurling stones on the informant and others, which caused injuries to them.
It is alleged against the petitioner that he assaulted the uncle of the informant by means of bricks.
Considering the nature of accusation and the submissions
advanced on behalf of the petitioner, this application is allowed. Let the petitioner above named in the event of his arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in Lalganj P. S. Case No. 213/2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
