The petitioners seek pre-arrest bail in connection with Hilsa P.S. Case No. 592 of 2017 registered under Sections 323, 147, 341, 504, 506, 353 and 379 of the Indian Penal Code. It is submitted by the learned counsel for the petitioners that there is general and omnibus allegation against six named accused and 30 unknown. He submitted that the petitioners are ladies and their names have been given simply because they are resident of the same locality. He also contended
Patna High Court Cr.Misc. No.58691 of 2017 (2) dt.12-12-2017 that the petitioners have got no criminal antecedent and having got roots in the society, they are not likely to abscond or tamper with the evidence.
Learned counsel for the State has opposed the application for grant of pre-arrest bail to the petitioners. Considering the facts and circumstances of the case and the fact that the petitioners are ladies and have got no criminal antecedent, in the event of arrest or surrender in the court below within six weeks from today, they are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1st, Hilsa, Nalanda in connection with Hilsa P.S. Case No. 592 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C.
