====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 21-12-2020 Heard the parties through the virtual court proceeding. The petitioner seeks bail in connection with Punpun P.S. Case No. 40 of 2020, G.R. No.102 of 2020 registered for the offences punishable under Sections 302, 120(B)/34 of the Indian Penal Code and Sections 25(1-B)a/26/27/35 of the Arms Act.

The prosecution case, in brief, is that the informant Vinod Kumar in his written information alleged that on 31.01.2020 at 6.20 am. His son Rahul Kumar, aged about 22 years, left the house for Gaya but did not come till late night. Subsequently, the informant came to know that one person has been shot dead by criminals towards south of village Jol Bigha. He learnt that the person shot dead was his on Rahul Kumar and his dead body has been sent to PMCH for postmortem. The

Patna High Court CR. MISC. No.28705 of 2020(3) dt.21-12-2020 2/2 informant alleged that some unknown criminals have killed his son Rahul Kumar by shooting him in the back of his head on 31.01.2020 at 8 pm.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case and he further submits that there is general and omnibus allegation against the petitioner. He further submits that only on suspicion, the petitioner has been made accused in the case. No any witness in the case diary has supported the prosecution case regarding involvement against the petitioner. Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of learned Sri Ranjay Kumar, Judicial Magistrate, First Class, Masaurhi in connection with Punpun P.S. Case No. 40 of 2020, G.R. No.102 of 2020.
