JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-12-2016 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Bidupur Police Station Case No. 231 of 2015, disclosing offences under Sections 304B/201/34 of the Indian Penal Code.

The petitioner nos. 1 and 2 are wives of Arvind Paswan and Dholan Paswan respectively;

whereas, petitioner no. 3 is the father-in-law of the deceased. The said Arvind Paswan and Dholan Paswan, who are brothers of the husband of the deceased are also accused in the said Bidupur Police Station Case No. 231 of 2015, who have

Patna High Court Cr.Misc. No.47804 of 2016 (3) dt.14-12-2016 2/3 been granted anticipatory bail by an order of this Court, dated 25.10.2016, passed in Criminal Misc. No. 43092 of 2016.

It is submitted on behalf of the petitioners that there is no direct allegation against them of demand of dowry or torture therefor.

Considering the above submission and the fact that other co-accused persons have been granted anticipatory bail, this application is allowed. Let the petitioners, namely, Rinku Devi, Priyanka Devi and Asheshwar Paswan @ Asheshwar Bhagat, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali, at Hajipur, in connection with Bidupur Police Station Case No. 231 of 2015, subject to the condition laid down under Section 438

(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds
