Petitioner prays for grant of anticipatory bail in Joki Hat (Mahalgaon) P.S. Case No. 289 of 2016 registered under sections 272, 273 of the Indian Penal Code and Section 47(A) of the Bihar Excise (Amendment) Act, 2016.
In course of patrolling, a tempo carrying three accused persons was chased. Two of them made their escape good whereas one person was apprehended. The informant claimed to have identified those accused persons also and one of them is the petitioner. From the tempo, 4 bottles of Royal Stag each containing 1 ltr. and one bottle containing 375 ml. of Royal Stag Classic were found kept in a cartoon. It is stated that petitioner has falsely been implicated in this case only on suspicion. The petitioner has no concern with the seized articles.
Patna High Court Cr.Misc. No.55145 of 2016 (2) dt.23-12-2016 2/2 Mr. Dayal, APP, on the other hand, states that the informant has specifically alleged participation of the petitioner in the alleged crime.
Considering the facts and circumstances of the case, in my view, it is not a fit case for grant of anticipatory bail. Prayer is refused.
