The petitioners apprehend their arrest in Barh P.S. Case No. 124 of 2016 instituted for the offence under Sections 147, 148, 149, 353, 332, 224, 225, 504 and 323 of Indian Penal Code.
It is alleged in the written report that accused persons obstructed the police party in their official duty and assaulted the police party and forcibly got rescued the accused Abhay Yadav from custody of the police.
There is general allegation that the sons, wife and daughters of Singheshwar Yadav, Indradeo Yadav threw bricks, stone on the police party and got rescued the accused. Besides this, there is no specific allegation against these petitioners. It is
Patna High Court Cr.Misc. No.97 of 2017 (2) dt.10-01-2017 2/2 submitted that both these petitioners are student and there is no criminal antecedent against these petitioners. In the circumstances, prayer of the petitioners for anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Barh P.S. Case No. 124 of 2016, they shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Barh, Patna, subject to the conditions as laid down under Section 438(2) Cr.P.C.
