JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-04-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Rasulpur P.S. Case No.133 of 2018 for the offenses under Sections 399, 402, 120(B) of the Indian Penal Code and 25(1b), 26 of the Arms Act. Allegation against this petitioner in the instant case is that he was a member of an unlawful assembly for committing crime.

Learned counsel for the petitioner submits that on search nothing was recovered from the conscious possession of the petitioner. The petitioner is in custody since 06.12.2018. Considering the fact that nothing was recovered from the conscious possession of the petitioner, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named,
