JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Ujiyarpur P.S. Case No. 150 of 2016 registered under Sections304(B)/34 of the Indian Penal Code. Petitioner happens to be agnate of husband of the deceased and submission on behalf of petitioner is that he does not have any concern with the family affairs of husband of the deceased.

Considering the above-said facts and circumstances of the case as well as submission of the parties and also taking note of this fact that the petitioner happens to be cousin father-inlaw of the deceased, let the petitioner named above, in the event of

Patna High Court Cr.Misc. No.55259 of 2016 (2) dt.12-01-2017 2/2 his arrest or surrender in the court below within four weeks from the date of receipt/production of copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Ujiyarpur P.S. Case No. 150 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, Dalsingsarai, Samastipur subject to condition as laid down u/S 438(2) of the Code of Criminal Procedure Code.
