JUSTICE BIRENDRA KUMAR ORAL ORDER 19-12-2016 Heard learned counsel for the petitioner and the State. This is an application for restoration of Cr. Misc. No. 44241 of 2016, which was dismissed for non-appearance of the petitioner on 05.10.2016.
It is submitted in para-3 of the petition that since learned counsel was arguing in some case in Court No.34, he could not reach on time during the aforesaid period and the case was dismissed for default.
Considering the facts and circumstances, the prayer for restoration is allowed subject to the condition that petitioner shall deposit Rs.500/- in the Victim Compensation Fund within three weeks from today.
