Petitioner apprehends arrest in a case registered for the offence punishable under Sections 307, 120(B)/34 of Indian Penal Code.

As per prosecution case, petitioner along with other FIR named accused person conspired and took Rs. 20 lacs from the brother of the informant. On demanding his money back, this petitioner sent two persons who fired at the brother of the informant and as a result he sustained grave injury. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that there is no specific allegation of firing against this petitioner. As a matter of fact, rather he is only alleged to be a conspirator and

Moreover, similarly situated co-accused, Manisha Jaiswal, has already been granted bail vide order dated 14.12.2021 passed in Cr. Misc. No. 14199 of 2021. Petitioner has got clean antecedent.

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihar, East Champaran in Mofassil Motihari P. S. Case No. 599 of 2019, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) navya/- U T
