The petitioner apprehends his arrest in connection with Nathnagar (Lalmatia) P.S. Case No. 320 of 2017, registered under Sections 366(A) and 379/34 of the Indian Penal Code. The accusation is of kidnapping of minor daughter of the informant by Dharmraj Yadav, with the help of his brother, Bansh Raj Yadav (petitioner), his father Shivam Yadav and friend Mukesh Yadav.
Learned counsel for the petitioner submits that while the allegation has been made against the petitioner to assist Dharmraj Yadav in the kidnapping of daughter of the informant, but the victim has made allegation about her kidnapping against Dharamraj Yadav, which would appear from annexure 2 to the
Patna High Court Cr.Misc. No.52170 of 2017 (2) dt.07-11-2017 bail application. In fact, petitioner has falsely been implicated in this case being the brother of Dharamraj Yadav. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Nathnagar (Lalmatia) P.S. Case No. 320 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
