The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that he came to know that a dead body was lying at Dusiyani Badhar and when the informant reached the place of occurrence he found the dead body of his brother, Ajit Kumar lying in a paddy field, it is next alleged that black marks and swelling on the neck of the dead body was found, it is further alleged that his brother was missing since 10:00 pm and thus

Patna High Court CR. MISC. No.37777 of 2021(2) dt.15-06-2022 2/3 suspected the hand of his co-villagers Basudeo Ram, Anant Kumar, Munna Kumar, Lav Kumar and 3-4 unknown persons in the murder of his brother and accordingly the F.I.R. was instituted.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. and the informant does not even remotely raises any suspicion against him, it is next submitted that Anant Kumar, Munna Kumar and Lav Kumar have been granted anticipatory bail vide order dated 14.07.2021 in Cr. Misc. No. 39416 of 2020.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner and the fact that co-accused have been granted anticipatory bail, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Obra P.S. Case No. 183 of 2020 subject to the conditions as laid down
