The petitioner apprehends his arrest in Muffasil P.S. Case No. 325/2016, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code. The informant named the petitioner along with other accused persons and alleged that when the informant came to enquire the reason for plucking braches of the tree, the petitioner and others assaulted the informant and others. Petitioner is alleged to have assaulted Saraswati Devi with spade.

Learned counsel for the petitioner submits that there is counter version bearing Muffasil P.S. Case no. 326/16. From the side of the petitioner many persons were injured. Mutual scuffle

Patna High Court Cr.Misc. No.55657 of 2016 (2) dt.12-01-2017 2/2 took place between the two sides on account of land dispute. Saraswati Devi got one lacerated wound on scapular region and the doctor opined the injury simple in nature. Considering the facts aforesaid and the fact that occurrence took place due to land dispute and on account of assault made by the petitioner simple injury is caused to Saraswati Devi, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Muffasil P.S. Case No. 325/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
