The petitioner apprehends his arrest in Simri P.S. Case No. 103/2016, registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code. Petitioner is Panchayat Secretary of Simri and Dulahpur panchayat and the present case is lodged for non-submission of folders and registers of appointment of Panchayat teachers of different panchayat.

Learned counsel for the petitioner submits that the petitioner joined as Panchayat Secretary in Simri panchayat in the year 2014 and he was also made Incharge of Panchayat Secretary of Dulahpur panchayat. Petitioner forwarded all the documents, he received from his predecessors vide annexure-5 on 27.07.2016.

Patna High Court Cr.Misc. No.41428 of 2016 (2) dt.19-11-2016 2/2 Petitioner did not submit other papers as he did not receive the same from his predecessors.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Simri P.S. Case No. 103/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
