Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Kochadhaman P.S. Case No. 295 of 2021, registered for the offences punishable under Section 379 of the Indian Penal Code. The learned counsel for the petitioner has submitted that the allegation of theft of motorcycle has levelled against the petitioner, only on the basis of suspicion.

On the other hand, the learned APP, Shri Shailendra Kumar has submitted that petitioner has one criminal antecedent of similar nature.
