From PPO No. 201411021057, which is annexed as Annexure- 5, it is pointed out by learned counsel for the petitioner that the State Government has treated the absence, as break in service between 04.01.1997 to 31.07.2010, which adds up to about 13 years and 7 months, as would be evident from notification, contained in Annexure-4, dated 10.10.2011. However, in the PPO, the non-qualifying period has been shown as 14 years, 8 months and 21 days.

Such discrepancy is obvious from reading of Annexure- 4 and 5. Instead of keeping the matter pending and adjourning for a response of the Accountant General, Bihar, the Court directs the Sr. Accounts Officer of the office of Accountant General,

Patna High Court CWJC No.16310 of 2015(4) dt.19-08-2017 2/2 Bihar, dealing with the pension of the petitioner to verify this position and if necessary make and keeping in mind Annexure4, if it is warranted that this period of non-qualifying service is wrongly reflected, then the necessary correction would be done and appropriate rectification would be made. All this must be done within a period of six weeks from the date of production of a copy of this order by the petitioner before the said authority. Writ Application stands disposed off in terms of above direction.
