Heard learned counsel for the petitioner and learned counsel for the respondents.
Patna High Court CWJC No.11286 of 2018(2) dt.06-01-2020 2/3 Petitioner has prayed for the following relief/s: "For constituting an Enquiry Commission to enquire about the highhanded conduct of respondentOfficials particularly Respondent No.3 and Respondent No.4 who have ab-initio conducted irregularities/illegalities in respect of so many issues that has been stated in details contained as Annexure-2 of this instant Writ application without following the procedure of U.G.C. Regulations prescribed for the same that has been contained in Annexure-1 in this Writ application and as such the official respondent Nos.3 and 4 are responsible for the same should be punished and prosecuted for their said wrong.
For commanding and directing the respondents to initiate an appropriate proceeding including the proceeding for criminal prosecution against the respondents concerned responsible for the said wrong in respect of mentioned as above.
For direction to the respondents concerned to adopt corrective measures in respect of on going irregularities/illegalities in Mahatma Gandhi Central University, Bihar for smooth functioning."
After the matter was heard for some time, learned counsel for the petitioner submits that petitioner shall be content if a direction is issued to the concerned respondents to consider and decide the representation, which the petitioner shall be making afresh within a period of four weeks from today.
Patna High Court CWJC No.11286 of 2018(2) dt.06-01-2020 3/3 Learned counsel for the State states that upon receipt of such request, if any, the same shall be dealt with in accordance with law, expeditiously and positively within a period of three months from the date of receipt thereof. Equally, liberty is reserved to the petitioner to take recourse to such alternative remedies as are otherwise available in accordance with law.
We are hopeful that as and when petitioner takes recourse to such remedies, as are otherwise available in law, before the appropriate forum, the same shall be dealt with, in accordance with law and with reasonable dispatch.
