The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 353, 323, 307, 504, 386, 379 and 120(B) of the Indian Penal Code.
When the police party was on patrolling duty one Dewanti Devi informed to the police that about 100 people are making forceful construction of a school on her land when the police reached there those people scuffled with the police and snatched the rifle of the police, however, returned subsequently. Submission is that entire allegation is false and in collusion with others just to pressurize the petitioner to not to construct the school.
Patna High Court Cr.Misc. No.52528 of 2016 (2) dt.07-12-2016 Considering the entire facts and circumstances of the case and the statements of the petitioner on oath that he has got no criminal antecedent, let petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran/Successor Court in connection with Chapra Muffasil Police Station Case No. 38 of 2016 corresponding to G.R. No. 796 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
