JUSTICE HARISH KUMAR ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 20-02-2024 In the above writ petition, the petitioner, who claims to be public-spirited, has sought for directions for the implementation of the Right of Children to Free and Compulsory Education Act, 2009 (for brevity, the RTE Act).

2. The questions of law raised are ambiguous, insofar as questioning the guidelines of the RTE Act and compliance of such guidelines.

3. In fact, another Division Bench of this Court, by order dated 02.05.2019 directed the petitioner to file an affidavit

Patna High Court CWJC No.9555 of 2019 dt.20-02-2024 2/2 giving details of government schools which are lacking on infrastructure of teachers. A supplementary counter affidavit was placed on record as on 03.09.2019.

4. The issue with respect to lack of infrastructure in schools have came up for consideration in C.W.J.C. No. 4281 of 2019, titled as Budhadev Mahto and Ors. v. The State of Bihar and Ors. A detailed counter affidavit was filed therein, bringing forth the various steps taken by the State Government to ensure the provision of necessary infrastructure in schools. This Court was satisfied that the State Government is taking positive steps to realise the goal of spread of education in the entire State and expressed the fervent hope that the efforts would continue unabated. The writ petition thus stood closed, which end result has to be applied in the above case also.

5. The writ petition would stand closed.
