The petitioner is in judicial custody in connection with Maniyari P.S. Case No. 16 of 2021 for the offence punishable under Sections 341, 323, 498(A), 304(B) of the Indian Penal Code and Section 3, 4 of D.P. Act lodged on 14.1.2021 by the informant, Chandeshwar Ram.

As per the prosecution story, the lady was married to the petitioner's brother but was tortured for dowry and on the fateful day, she was assaulted and set ablaze. She was left at the place to die. However, it was the police came and took her to Sri Krishna Medical College and Hospital, Muzaffarpur where she succumbed to the burn injuries.

In this case, a coordinate bench had called for the case diary which has since been made available and the learned APP

Patna High Court CR. MISC. No.29416 of 2023(4) dt.18-08-2023 2/2 has taken this Court to paragraph-16 of the petition which is the statement of the victim lady who is now no more. According to her, the father-in-law and mother-in-law and the present petitioner as also a villager came and assaulted her and set her ablaze.

Considering the kind of allegation that has come against the petitioner, no relief can be granted to him and the petition stands rejected.
