2. The petitioner is in custody in a case registered for the offence punishable under Section 64 of the BNS, 2023.

3. Allegation against the petitioner, who is step father of the victim, is to have committed rape upon the daughter of informant and she became pregnant by six to seven months.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to suspicion. He next submits that the petitioner has got clean antecedent as stated in para-3 of the petition and he is in custody since 13.12.2025 and petitioner is step father of the victim.

5. Learned APP for the State opposes the prayer for

Patna High Court CR. MISC. No.27708 of 2026(3) dt.15-07-2026 2/2 bail of this petitioner and submits that the petitioner is committing rape since last two years ago.

6. On perusal of the first information report, case diary and impugned order dated 02.04.2026, it appears that the petitioner is step father of the victim and he established physical relationship with her and petitioner was doing this act since last two years and upon this act, she became pregnant by six to seven months and when the victim resist this act, he used threatened to kill her. In para-3 of the case diary, it appears that several witnesses have supported the version of the prosecution and this is very serious nature of offence, considering which, I am not inclined to grant regular to the petitioner.

7. Accordingly, the prayer for regular bail of the petitioner is hereby rejected.
