The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 379, 411 and 34 of the Indian Penal Code.
The prosecution case is that the In-charge Headmaster of Primary School, Sudarshan Bigha, namely, Alok Kumar, and the petitioner were going to sell rice of Mid Day meal scheme in the market, but seeing the people they left the bag and escaped from the scene.
It is submitted by learned Counsel appearing on behalf of the petitioner that the petitioner is not related to the school in question, rather he is simple labourer. There is no recovery from the petitioner. A statement has been made in paragraph no.3 of
Patna High Court Cr.Misc. No.51654 of 2017(2) dt.10-11-2017 2/2 the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Gaya, in connection with Guraru P.S. Case No. 65 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Dinesh Kumar Singh, J) Ashwini/- U T
