Heard both parties.
The petitioner seeks bail in Sono/Charkapathar P.S. Case No. 127 of 2015, registered for the offence punishable under Sections 120(B)/34 of the Indian Penal Code, sections 16, 17, 18, 19, 20, 21 and 22 of the UAP Act and section 3/4 of the Explosive Substance Act.
As per the prosecution case, 02 persons were nabbed by the CRPF personnel and from their possession 50 Kg of Ammonium Nitrate in a plastic bag used for explosion was recovered and they disclosed the name of 04 persons including this petitioner.
It is submitted on behalf of the petitioner that nothing
Patna High Court CR. MISC. No.38089 of 2021(2) dt.23-09-2021 2/2 has been recovered from conscious possession of this petitioner. Petitioner has been made accused on the basis of confessional statement of co-accused. Petitioner has not been arrested on the spot and has got clean antecedent and he is in custody since 10.02.2021. Moreover, similarly situated co-accused have been granted bail by this Hon'ble Court.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Jamui in connection with Sono/Charkapathar P.S. Case No. 127 of 2015, subject to following conditions:- (i) The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and in the event of failure on two consecutive dates without sufficient reasons, his bail bond shall be liable to be cancelled by the court below. (ii) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
