1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The learned counsel for the petitioners seeks permission to withdraw the anticipatory bail application with respect to petitioner no.3, namely, Rahul Kumar Paswan.
3. Permission is accorded.
4. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 379, 353, 332, 333, 307, 342, 506, 504 of the Indian Penal Code.
5. Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.41133 of 2024(4) dt.26-07-2024 2/3 petitioners have antecedent of two cases and have been falsely implicated in the instant case by the informant. It is further submitted that from perusal of the allegation, as alleged in the F.I.R., it would manifest that no specific allegation is alleged against the petitioners except that they were also members of unlawful assembly. It is further submitted that the informant in order to coerce Rahul Kumar Paswan into submission implicated his family members including the petitioners who are father and brother of Rahul. It is further submitted that similarly situated co-accused Om Prakash @ Om Prakash Paswan had moved this court seeking anticipatory bail by filing Cr. Misc. No.5163/2024 and the same was allowed by an order dated 26.02.2024.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
5. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned trial court where the
Patna High Court CR. MISC. No.41133 of 2024(4) dt.26-07-2024 3/3 case is pending/successor court in connection with Baunsi P.S. Case No.92/2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
