The petitioner apprehends his arrest in connection with Katihar Sahayak P.S. Case No.504 of 2017 registered under Sections 457 and 380 of the Indian Penal Code. The accusation is that in the night of 19/20.07.2017, when the informant woke, he did not find his mobile and saw the door of the Godrej opened. On verification, the informant found that the thieves entered into his house after climbing on the wall. Earlier, in the year 2016, this petitioner and Rohit Kumar had stolen his mobile, which was, later on, recovered. The informant raised suspicion against this petitioner and Rohit Kumar having hand in the theft of his mobile.
Patna High Court Cr.Misc. No.51115 of 2017 (3) dt.01-11-2017 2/2 Learned counsel for the petitioner submits that it would appear from the F.I.R. that the informant has only raised suspicion against the petitioner and Rohit Kumar having hand in the commission of the alleged occurrence.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar, in connection with Katihar Sahayak P.S. Case No.504 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
