Let the defect (s), as pointed out by the office, be removed within a period of four weeks from today. The petitioner seeks bail in connection with a case registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Sections 30(a) and 36 of Bihar Prohibition and Excise Act.

Allegation is of recovery of 43.120 liters of foreign liquor from the house of the petitioner.

Learned Counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the alleged recovery is from the

Patna High Court CR. MISC. No.29044 of 2022(3) dt.19-10-2022 2/2 ancestral house of the petitioner and he has no concern with the seized illicit liquor. No incriminating articles have been recovered from the possession of the petitioner. Further, it is submitted that the petitioner is in custody since 25.03.2022, charge-sheet has been submitted in the case and has clean antecedent.

Learned A.P.P for the State opposes the prayer for bail of the petitioner.

Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) only with two sureties of the like amount each to the satisfaction of the learned Exclusive Spl. Judge (Excise) Court No.-1, Muzaffarpur, in connection with Ahiyapur P.S. Case No. 482 of 2020.
