This application for grant of anticipatory bail arises out of Dinara (Bhanas) P.S. Case No. 110 of 2010, disclosing offence under Section 364 of the Indian Penal Code. It transpires that anticipatory bail application filed on behalf of co-accused Lal Bihari Choudhary and some others has been rejected by this Court vide order dated 20.09.2016 passed in Criminal Miscellaneous No. 39893 of 2016. The allegation against Lal Bihari Choudhary and the petitioner are almost identical. Considering the above, this application for anticipatory bail is, hereby, rejected.

The petitioner is directed to surrender before the court

Patna High Court Cr.Misc. No.44737 of 2016 (2) dt.28-10-2016 2/2 below within six weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
