1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Lalitgram Police Station Case No. 60 of 2024, disclosing offences under Sections 309(4) of the BNS, 2023.
3. The prosecution case, in short, is that on 23.12.2024 at about 3:30 P.M., three unknown persons allegedly assaulted the informant near Quarter Chowk and robbed his purse, mobile phone, bag containing Ayurvedic goods, cash of Rs. 3,000/-, and motorcycle bearing registration no. BR50AE8807, after which the present case was instituted.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the
Patna High Court CR. MISC. No.29377 of 2026(2) dt.07-05-2026 2/3 present case. The name of the petitioner has transpired solely on the basis of the confessional statement of co-accused Vikaram Kumar Mukhiya made before the police. It is next submitted that nothing incriminating has been recovered from the conscious possession of the petitioner and the allegations levelled in the F.I.R. are false, baseless and malicious. It is further submitted that the ingredients of the alleged offences are not attracted against the petitioner. Similarly situated co-accused person has been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 27.11.2025 passed in Cr. Misc. No. 77222 of 2025.
5. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that similarly situated co-accused person has been granted anticipatory bail by a Co-ordinate Bench of this Court, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, First
