Versus
1. The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :
For the Petitioner/s : Mr. Shaishav Kumar For the Opposite Party/s : Mr. Sri Ramchandra Sahani ====================================================== CORAM: HONOURABLE MR. JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-01-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
This application, for grant of anticipatory bail, arises out of Kalyanpur P.S. Case No. 57 of 2017 disclosing offences under Sections 304(B), 201/34 of the Indian Penal Code. The deceased admittedly died within seven years of the marriage under un-natural circumstance. The petitioner is the husband of the deceased.
Considering the gravity of the offence, since the petitioner is the husband of the deceased and it appears from the statement made in paragraph-3 of the application that petitioner is involved in other criminal cases also which is an additional ground for rejecting the petitioner's prayer, I am not inclined to grant
Patna High Court Cr.Misc. No.53571 of 2017 (3) dt.04-01-2018 2/2 privilege of anticipatory bail to the petitioner. The prayer stands rejected accordingly, in connection with Kalyanpur P.S. Case No. 57 of 2017 pending before learned Chief Judicial Magistrate, Samastipur.
