JUSTICE SANJAY PRIYA ORAL ORDER 22-05-2018 Counsel for the petitioner submits that the petitioner was earlier granted anticipatory bail by this Court on 23.01.2018, passed in Cr. Misc. No. 21948 of 2017. The application was disposed of with a direction to the petitioner to surrender before the Court below along with valid receipt showing payment of Rs.2,80,000/-. The petitioner could not comply the aforesaid direction. Thereafter, a modification petition was filed which was allowed by order, dated 07.03.2018, passed in Cr. Misc. No. 12757 of 2018. The counsel for the petitioner submits that the petitioner could not make arrangement of the money within the time, but he has now

Patna High Court Cr.Misc. No.31127 of 2018(2) dt.22-05-2018 2/2 deposited the money amounting to Rs.2,80,000/- in the account bearing Account No. 11424747267 in the branch of the State Bank of India of North Bihar Power Distribution Company Limited, dated 30.04.2018.

Counsel for the petitioner seeks extension of time to surrender before the Court below in terms of statement made in paragraph 6 of the petition.

The petitioner is given four weeks further time, from the date of receipt/production of a copy of this order, to surrender before the Court below along with the valid receipt showing payment of money of Rs.2,80,000/- to the Electricity Department in terms of earlier order passed by the Court on 23.01.2018 in Cr. Misc. No. 21948 of 2017. The Department being satisfied that the aforesaid amount has been deposited, the petitioner will be enlarged on anticipatory bail on same terms and conditions as noted in the order, dated 23.01.2018, passed in Cr. Misc. No. 21948 of 2017.
